Aereo is a scrappy startup service that delivers over-the-air TV to computers and mobile devices for $8/month. But it is also a strategic weapon that media mogul Barry Diller and other well-heeled investors want to use to drive a stake into the heart of the current business model of cable TV, which is based on selling customers large bundles of channels they often don’t want.

We now have a date for the most closely watched court case in the TV and entertainment industry. A recusal increases the chance of a tie (and a win for Aereo).

My Two Cents

I hardly can remember so far back as when I sold technology to cable, satellite and IPTV co's. But now Aereo stands on the precipice of creating a whole new platform. If in doubt, I usually root for the disrupter!! The cable cartel deserves whatever pain is wrought upon them by the Courts. When the Court's have to intervene to protect a business, then that business is in trouble.

Very interesting times for cable and IPTV co's -- on one hand, they get a positive ruling on net neutrality, but on the other hand, the NY Ct. of Appeals gives Aereo a fighting chance (and with the Alito recusal), all Aereo has to do is get a 4-4 tie. I would go so far as to say that the "super-experts" are pretty sure which way this one is going to go based on past history of the Justices.
